8:30 o’clock a.m. The Pledge of Allegiance was recited to the Flag.
Dale moved to appoint Fred M. Devish as Chairman of the Board of Crook County Commissioners and to appoint Bob Latham as the Vice-Chairman of the Board of Crook County Commissioners. Bob seconded, all ayes, motion carried.
Heath Turbiville was present to explain a change order for HDR. After discussion, Bob moved to approve and for the chairman to sign a Change Order between HDR Engineering, Inc., and Crook County to accept the updated 2025 billing rates. Dale seconded, all ayes, motion carried.
Bob moved to appoint Fred M. Devish as Crook County’s voting member of the Wyoming County Commissioner’s Association. Dale seconded, all ayes, motion carried.
Dale moved to appoint Bob Latham as the Commissioner’s member of the Crook County Volunteer Firefighters Association Advisory Board. Fred seconded, all ayes, motion carried.
Bob moved to ratify & approve the minutes from December 3, 4 and 16, 2024. Dale seconded, all ayes, motion carried.
Dale moved to approve and for the chairman to sign a Business Associate Agreement between Willis Towers Watson Insurance Services West Inc. and Crook County on behalf of WEBT. Bob seconded, all ayes, motion carried.
Bob moved to approve the following resolutions:
RESOLUTION NO. 2025-1
DESIGNATING THE OFFICIAL DEPOSITORIES FOR CROOK COUNTY FOR 2025
WHEREAS Wyoming Statute §9-4-816 through 9-4-831 governs the deposits and investments of county funds by Crook County; and
WHEREAS Resolution No. 8-1996 Statement of Investment Policy for Crook County allows investment of county funds while assuring the maximum safety of those funds; and
WHEREAS Wyoming Statute §9-4-817 (b) requires the County Treasurer to select the institutions designated by the Board of County Commissioners in and for Crook County, Wyoming pursuant to the restrictions stated therein and pursuant to law; and
WHEREAS the following financial institutions and State Treasurer should be designated as the official depositories for the public funds invested by Crook County as authorized by Wyoming Statute §9-4-831, namely: Sundance State Bank, Pinnacle Bank, Summit National Bank and any investment made available to the county through the State Treasurer of Wyoming, including the local investment pool, known as Wyo-Star authorized by W.S. 9-1-416 and the long-term investments pool, known as Wyo-Star II Wyoming Class authorized by W.S. 9-4-831 (a) (xxvii);
THEREFORE, be it resolved by the Board of County Commissioners in and for Crook County, Wyoming that the above stated depositories are designated as the official depositories of Crook County, Wyoming and that the County Treasurer, County Fair and Library, other elected officers and departments are authorized to and shall only deposit and invest county funds in these depositories.

RESOLUTION NO. 2025-2
AUTHORIZING THE ACCEPTANCE OF NEGOTIABLE PAPER
IN PAYMENT OF FEES
WHEREAS Wyoming Statute §18-3-505 provides that the Board of County Commissioners may allow any county officer, agent or employee to accept negotiable paper including, but not limited to e-checks, credit and debit cards, electronic funds transfer in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit; and
WHEREAS any fees assessed for processing negotiable instruments, a credit card, other electronic funds payment or other payment shall be borne by the person tendering payment and any fees assessed for processing a credit card payment collected on behalf of the county and state shall be borne by the person tendering payment and not by the county and state; and
WHEREAS with respect to lender credit card and all other payment transactions the county is entitled to promptly present all negotiable paper to the bank upon which the negotiable paper is drawn for payment without any right of setoff or defense on the part of the issuer except as follows: Acceptance by the county of an expired card, Acceptance of a card for payment of an amount in excess of what the issuer authorized the county to accept, or Negotiable paper that is so improperly completed that the issuer cannot identify the card holder; and
WHEREAS any defense, claim or action that an individual using negotiable paper, a lender credit card and electronic funds transfers might have against issuers of the card shall not apply to the county, its officers, agents or employees or relieve the individual of responsibility for payment; and
WHEREAS the acceptance of negotiable paper or any other type of payment constitutes conditional payment for the amount owing. If the negotiable paper or any other type of payment is not dishonored the payment shall be effective on the date the paper was accepted by the county officer, agent or employee and receipted the same day, with the exception that the transaction could not be completed for a statutory reason. If the negotiable paper or any other type of payment is dishonored in the course of collection the conditional payment is of no effect and any receipt, certificate or license issued upon acceptance of the negotiable paper or any other type of payment is void. In the event any property including motor vehicle license plates is transferred or issued by the county or any of its officers, agents or employees upon acceptance of negotiable paper, and the paper is subsequently dishonored the county may rescind the transaction and a sheriff or other law enforcement officer may without prior court proceedings seize the property pursuant to W.S. 18-3-505(e). Neither the rescission nor seizure relieves the person presenting the negotiable paper from further civil or criminal liabilities as may be provided by law.
WHEREAS any negotiable paper including but not limited to e-checks, credit and debit cards, electronic funds transfer in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit, that is dishonored shall be collected in the following manner or a more restrictive if imposed by the officer or board:
1. Once the negotiable paper has been dishonored it shall be resubmitted once, and if still dishonored the officer, or employee within ten (10) days shall issue a written demand to make the payment.
2. Then if the payment remains unpaid the officer or employee shall rescind the transaction and deliver the dishonored negotiable paper to law enforcement for further action.
THEREFORE, be it resolved by the Board of County Commissioners in and for Crook County, Wyoming that:
1. Any county officer, agent or employee is allowed to accept negotiable paper including credit cards in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit.
2. Any county officer, agent or employee who accepts negotiable paper is not personally liable, if the paper is dishonored and follows the collection process as required herein. Any losses arising from dishonored paper shall be allocated to the respective funds for which the negotiable paper was accepted.
3. In the event of losses from dishonored paper when the county or any of its officers are collecting funds for the state or any other level or unit of government, such losses shall be allocated to and accepted by the governmental entity for whom the collections were made;
3. Any payment made thereby is conditional as set forth in Wyoming Statute §18-3-505; and
4. Any fees assessed for processing a credit card payment, negotiable paper or other electronic funds transfers shall be borne by the person tendering payment.

Dan Thomas, County Assessor, Joseph Baron, County Attorney, Julie Crawford, Clerk of District Court, Jeff Hodge, County Sheriff and Tammy Jundt, County Treasurer were present to go over items of interest within their departments.
Dan Thomas, County Assessor: Last month in the Assessor’s Office we processed 32 deeds of ownership transfer. The field crew continues to work through the end of year new construction reviews. I have started the valuation process for the entire County. I attended the IT Committee meetings, as well as two meetings for the designation from IAAO that I am working towards. This month I will attend the WCAA winter meetings in Cheyenne as well as attending the Legislative session.
Joe Baron, County Attorney: Criminal Cases in the past month: New Cases: 28 Closed Cases: 19 Current Case Load: 100 In Court: 32 times Juvenile/Diversion Cases: 18 Civil projects: Work on various County Road right-of-way easements, resolutions, vacations, alteration and establishment matters on CR-38, 197, and 251; bridge matters on CR 93 and 112; and FERTA easements on the Forest Service. Reviewed subdivision applications, septic permit enforcement, legislation review, budget review, MOUs, leases, agreements, state and federal grant contracts, election issues and Opioid funding reporting.
Julie Crawford, Clerk of District Court: I received 9 new case filings, processed 32 record searches, 13 new passports, assisted multiple other customers with renewal passports and photos, 1 new appeal and there are now 2 civil appeals in process. I processed 309 total filings with 298 transactions being filed through eFiling. I filled my Chief Deputy position, and she is scheduled to begin work on January 2nd. I attended a courtroom security meeting, 5 E-Filing and Clerks’ Association teams meetings and 2 IT Committee meetings.
Melissa Jones, County Clerk: recorded 366 documents and made 316 titles, balanced poll books, gave voting credit and closed out the General Election and prepared purge notices, worked with Joe on several outstanding County Roads, worked on the annual MOU with VOANR, requested and received from WYDOT a MVR on all county employees who are listed as a driver on our insurance, completed September Opioid reports more due in January, worked with the Auditor on fixed assets, had a meeting with Joe and Eric on a voter issue, we are working on year-end duties attended the Compensation Committee meeting and IT Committee meeting.
Jeff Hodge, County Sheriff: Presented jail stats, have a deputy at the academy, filled the open detention spot, still working on the state inmate contract, had conversations with Charlie on Pine Haven repeaters, got grant for encrypting radios, tracking legislation, new rifles came in and we are working on the rifle buy back, attended court security meeting, looking into new notification systems, talking with Fire on dispatch/radios.
Tammy Jundt, County Treasurer: Total receipts were $4,978,726.92 and disbursements to the county boards, towns and schools were $5,209,044.90. In December we did a total of 4,963 transactions. We generated and mailed the February motor vehicle renewal reminder cards. I mailed the mineral production refund checks for those who had remitted over payments to the Wyoming Department of Revenue for their 2024 estimated taxes. We were very busy at the counter with mobile machinery renewals and many motor vehicle renewals which consist of issuing new plates; and collected property tax payments for the December 31st deadline. I attended the employee compensation meeting.
Discussion was held on a motion made last meeting, to live stream Commissioner meetings. After discussion Bob made a motion to rescind that motion to do more research on how to handle them, what the cost will be, who will maintain the system, how we will archive the videos and so forth. Further discussion was held, Dale seconded, all ayes, motion carried.

Alex Jessen, Chairman, Tammy Jundt, Bonnie Stahla & Morgan Ellsbury, Members, Compensation Committee, gave a monthly report. Also present were Julie Crawford, Larry Schommer, Jeff Hodge and Joe Baron.

After discussion, Dale moved to approve the following resolution:
RESOLUTION NO. 2025-3
ALTERING A PORTION OF COUNTY ROAD NO. 251
KNOWN AS WILLIAMS DIVIDE COUNTY ROAD
WHEREAS, the Crook County Road and Bridge Superintendent entered into an oral agreement with Watson Land LLC to alter a portion of Williams Divide County Road to change the course so it would be safer for users of the county road; and
WHEREAS, the agreement was mutually beneficial to both parties and in the interest of the economy and the public good; and
WHEREAS, Watson Land LLC and Green Mountain LLC granted Crook County an “EASEMENT AND CONSENT TO THE ESTABLISHMENT OR ALTERATION OF CROOK COUNTY ROAD #251 KNOWN AS WILLIAMS DIVIDE COUNTY ROAD”, which was recorded at Instrument Number 691094 at Book 678 photos Page 71 and Instrument Number 691095 at Book 678 photos Page 74 respectively; and
WHEREAS, the Board of County Commissioners have the authority pursuant to W.S. 24-3-108 to establish or alter a county road when in their judgement such action shall be in the interest of economy or the public good and the road is of sufficient importance to be opened and traveled; and
WHEREAS, this road is located across the following described real property, to wit;
Township 51 North, Range 61 West, 6th P.M. Crook County, Wyoming
Section 31: NE1/4NE1/4 ; NW1/4NE1/4
Section 30: SE1/4SE1/4
and more specifically described in the Crook County Clerk’s Office in Sundance, WY at Instrument Number 689024 at Rod 27 Map 1668 recorded on April 2, 2024.
THEREFORE BE IT RESOLVED AND ORDERED by the Board of County Commissioners in and for Crook County, Wyoming that:
1. County Road No. 251 known as Williams Divide County Road where the Easement set forth above was granted to the County is hereby Declared as altered from its original location in the same forty acre tract to its new location and is hereby established as a County Road, for use by the public, pursuant to W.S. 24-3-108 and said County Road is sixty-six feet wide, that is, thirty-three feet on each side of the centerline of the route described in the legal descriptions and easements set forth above.
2. This Resolution shall be indexed and noted in the County Road Index and County Road Map Book, and the land records of the Crook County Clerk, in Sundance, WY.

Present for the final hearing of the Ferguson Minor Subdivision Re-Plat of Lot 2 were Kevin Rehbein, Shelley, Rehbein, Morgan Ellsbury, Caleb Peters, Tim Lyons and Joe Baron. After discussion, Bob moved to approve the Order Conditionally Approving Minor Subdivision Re-Plat for Ferguson Minor Subdivision, the Minor Subdivision Re-Plat and the Minor Subdivision Unrecorded Subdivision Plat Agreement. Present for the hearing of the Abe Yoder Septic Violations were Sarah Pridgeon, Tim Lyons, Morgan Ellsbury, Caleb Peters and Joe Baron. Mr. Yoder did not appear. Caleb stated that he did receive a phone call from Mr. Yoder, in that call Mr. Yoder indicated that he would be mailing a letter to the Clerk requesting the hearing be continued. The Clerk has not received that letter to date. Dale moved to continue the hearing to February 4, 2025, at 1:30 o’clock p.m. Fred seconded, all ayes, motion carried.
Megan Nelms, Senior Planner, Y2 Consultants, was present via Teams to discuss the plan to Update the County’s Comprehensive Land Use Plan. Also present were Morgan Ellsbury, Caleb Peters, Tim Lyons and Joe Baron. Ms. Nelms expressed that the best first step would be for the Board to put together a steering committee to guide the preparation of the County Comprehensive Land Use Plan Update. The Board will advertise for 7-10 interested parties to fill serve on said committee.

Steve Dietrich, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.
Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Foreman, continued their monthly reports.
Larry introduced Jalen Rowell and Jonathan Stordahl to the Board.
Soni Lampert, KLH, was present via Teams, for the monthly IT update. Also present were Jalen Rowell, Julie Crawford, Tammy Jundt, Larry Schommer and Jeff Hodge.

Discussion was held on fires that occurred this past fire season that expenses were reimbursed to the County from the State. Since we are unable to anticipate the expenditures and revenues for such fires during budget time a budget amendment is now necessary to balance the expenditures to revenues for said fires.
Bob moved to transfer funds as follows: Pursuant to Wyoming Statute 16-4-112, notice is given that a Resolution has been proposed to transfer the following funds. Notice is further given that a hearing of the Board of Crook County Commissioners of Crook County, Wyoming, will be held on February 4, 2025, at 8:30 o’clock a.m. to consider such proposed resolution.
