PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS AT THE COURTHOUSE IN SUNDANCE, CROOK COUNTY, WYOMING

8:30 o’clock a.m. Present were Chairman Fred M. Devish, Vice-Chairman Kelly B. Dennis, Member Bob Latham and County Clerk Melissa Jones.

The Pledge of Allegiance was recited to the Flag.

Kelly moved to approve and ratify the minutes from March 5 & 6, 2024. Bob seconded, all ayes, motion carried.

Bob moved to approve the health insurance proposal with WEBT. There will be no changes from last year, with the County paying 100% of an employee only policy and 80% on all other health plans. Vision and dental will be employee paid. There was a 16% increase to the health insurance premiums and a 7% increase to the dental premiums. Kelly seconded, all ayes, motion carried.

Kelly moved to approve the final FY22-23 audit. Bob seconded, all ayes, motion carried.

Bob moved to approve a Cooperative Law Enforcement Agreement Between the County of Crook and the USDA, Forest Service Black Hills National Forest. Kelly seconded, all ayes, motion carried.

Kelly moved to sign a letter to USFS requesting Cooperating Agency Status. Bob seconded, all ayes, motion carried.

Bob moved to approve a License for use of County Road or Property with Range Telephone Cooperative on Rifle Pit Co. Rd. No. 108. Kelly seconded, all ayes, motion carried.

Kelly moved to transfer funds as follows: Pursuant to Wyoming Statute 16-4-112, notice is given that a Resolution has been proposed to transfer the following funds. Notice is further given that a hearing of the Board of Crook County Commissioners of Crook County, Wyoming will be held on May 7, 2024, at 8:30 o’clock a.m. to consider such proposed resolution.

RESOLUTION 2024-10

UPON FORMATION PETITION OF THE

BEULAH IMPROVEMENT AND SERVICE DISTRICT

WHEREAS the petitioners for the formation of an Improvement and Service District filed their petition pursuant to W. S. 18-12-101 et seq. and W. S. 22-29-101 et seq. had filed a Petition for the formation of a district to be known as the “Beulah Improvement and Service District”;

WHEREAS the Board of County Commissioners in and for Crook County, Wyoming held a hearing to consider the petition to form an Improvement and Service District hearing on February 7, 2024, at 2:00 P.M. at the Board of County Commissioners Chambers in the Courthouse in Sundance, Wyoming;

WHEREAS the petition for formation was granted by the Board for the creation of the proposed district that shall be limited to “those purposes set forth in the Wyoming Improvement and Service Districts Act pursuant to W.S. 18-12-112 and 141”;

WHEREAS the Beulah Improvement and Service District boundaries are set forth on Legal Descriptions on Exhibit A and maps labeled as Exhibit B, both that were attached to the ORDER UPON FORMATION PETITION and includes the following described property, to-wit:

Lots 1-32 Beulah Land Estates Subdivision, 6th P.M., Crook County, WY

Lots 1, 3, 4, & 5 Redwater Estates Subdivision, 6th P.M., Crook County, WY

Township 53 North, Range 60 West, 6th P.M., Crook County, WY

Sec 30 – a tract located in the SW1/4SW1/4 containing 5.72 acres.

Sec 30 – a tract located in the SW1/4 containing 11.20 acres.

WHEREAS all said landowners have had thirty (30) days after adjournment of the hearing on February 7, 2024, and entry of the ORDER UPON FORMATION PETITION dated February 7, 2024, to file written protests against the formation of the district, and none have been filed with the County Clerk concerning this matter;

WHEREAS the owners of at least thirty-five percent (35%) of assessed valuation of property included in the proposed district, have not presented any written protests against the formation of the district to the Board of County Commissioners, so the proposed district modified by the Board of County Commissioners does not fail and shall continue to proceed;

IT IS THEREFORE RESOLVED by the Board of County Commissioners in and for Crook County, WY that:

The County Clerk shall conduct an election to establish the district and an election to elect the initial Directors by selecting one (1) Director for one four (4) year term, two (2) Directors for two (2) year terms, until their successors are elected and qualified at the regular scheduled subsequent director election as provided in W.S. 22-29-112, publish notice of the election in The Sundance Times at Sundance, Crook County, Wyoming as soon as legally possible; The County Clerk shall hold the election by mail ballot or on the next election date authorized under W.S. 22-21-103.Any election shall be at the expense of the sponsors, and the Clerk shall not commence to proceed with the election until receipt of an initial deposit of $1,500.00 to conduct the election. Any errors or changes on the map or in the legal description shall be corrected, and the corrected version shall be displayed at the polls on election day or included in each mail ballot package. The map shall be developed after consultation with the County Assessor to ensure accuracy.

Discussion was held on the Board of Equalization process/timelines for 2024. Dan, Melissa, Joe and Doug Stevens will work together to create a schedule for the year.

Dan Thomas, County Assessor, Joseph Baron, County Attorney, Julie Crawford, Clerk of District Court, Jeff Hodge, County Sheriff and Tammy Jundt, County Treasurer were present to go over items of interest within their departments.

Dan Thomas, County Assessor: This last month was busy for the Assessor’s Office. We have finished up most of our processing and valuing for the 2024 tax year. Fifty-three deeds of transfer of ownership were filed with the Clerk’s Office and are recorded in our records. I was present in Cheyenne as well as following the Budget Session via zoom for testimony and any assistance needed for the property tax bills last month. I attended many meetings with the Assessor’s Association and the Department of Revenue last month for ways to administer these new exemptions. I plan to mail out the Notice of Assessments on April 18th of this year. Also, my mailing service will be providing a way for everyone to access their Notice of Assessments online and the instructions will be on the Notice of Assessment when it gets mailed out. The property tax refund program has changed its bounds and writing for qualifying applicants. Applications open on April 30th this year for the property tax refund program. Also, for this year only there will be an exemption of anything higher than a 4% increase in valuation on just the primary residential structure of your property taxes. For the 2025 tax year and on this exemption cap at 4% will apply to both the land and the home. For next year there will be an increase in the Veteran’s exemption to $6,000 of assessed value which is double what the exemption will be for the 2024 tax year. Also, for next year their will be a homestead exemption for Crook County property owners that have paid property taxes in the county for 25 years and are sixty-five years or older.

Julie Crawford, Clerk of District Court: Total Receipts: $17,021.98 with $3,101.57 to the County 14 new case filings 25 record searches 10 new passports, assisted multiple other customers with renewal passports 1 new civil appeal – 2 total in process (Raney v CC Assessor/Board of Equalization) E-Filing is going well. We have had several new cases filed through this process, along with many individual document filings. It seems to be a good system for the most part – there have been a few issues but on the whole, it is good so far. Until we go paperless, it is going to cost us more than traditional filings. We now have to print all e-filings to place in the case files vs. the parties providing the copies with traditional filings, but we are just not ready to abandon paper files yet. We are now down to the final 27 potential jurors who have not yet responded, so Order to Show Causes were taken to the Sheriff’s Office for service on them in an attempt to get them to return the Juror Questionnaires. If they do not submit their questionnaires by April 10th, they will be required to appear before the Judge on April 11th. I attended a teams meeting with the Supreme Court and File and Serve Express regarding e-filing, another teams meeting for District Courts, a teams training on Schoox which is one of our training platforms for new processes and procedures, and part of the Department Heads meeting in between Court. Business seems to be increasing, which is normal for this time of the year.

Tammy Jundt, County Treasurer: Total receipts were $1,779,590.26 and disbursements to the county boards, towns and schools were $847,471.41. In March we did a total of 2,091 transactions. Since February has past, we have slowed down a little in our office. We are catching up on other things that we were not able to get done in February. Completed the 2023 plate and tab abstract and submitted it to WYDOT. The State has funded the Wyoming Property Tax Relief Program again for the 2023 taxes. They did extend the due date to the 2nd Monday in October. We have not received any applications to hand out yet. We’ve been working with the DOR to convert to remitting our monthly sales tax online instead of the paper form and sending it through the mail.

Jeff Hodge, County Sheriff: following discussions on 2nd Amendment and Elections, himself and a couple deputies went to Campbell County to help search for the missing woman, been working on patrol contracts and dispatch fees for the municipalities and other agencies, had a meeting with Keyhole State Park.

Melissa Jones, County Clerk: Office recorded 460 documents, issued 290 titles, completed the LGLP renewals, have been collecting the deposit fees on the petition for Co Rd No 38, send out notice of consideration on Co Rd No 51, verified with the party chairman the number of precinct people to be elected in 2024, verified with the towns and special districts the positions to be on the 2024 ballot, Aimee has been working on retaining election judges I will send a letter to the towns and party chairmen on number of election judges needed, traveled to Hulett to talk with the senior class about elections, attended the Department Heads meeting and the Compensation Committee meeting.

Joe Baron, County Attorney: Criminal Cases in the past month: New Cases: 11 Closed Cases: 40 Current Case Load: 56 In Court: 35 times Juvenile/Diversion Cases: 42 Reviewed, rejected and approved various Treasurer Bonds. I require minutes electing the treasurer to their statutory term of office. The Boards should also be reviewing and approving the amount of bond to ensure that it meets the statutory requirement. Filed several responsive briefs with the State Board of Equalizations and filed motion with County Board of Equalization. Reviewed and advised Planning Board and Staff on several subdivisions. Continued work on petitions to vacate portions of County Road No.38 and 51; and Easements for a change to Road # 251. Filed Opioid Fund Settlement reports reviewed receipt of additional funding of $13,000.85, and applications for funding educational programs for the schools. Attended IT and department head meeting on upcoming IT needs for budgeting and discussed changes to the Employee Handbook. Reviewed various legislation. Submitted state grant funding requests for $71,374 for the 2025 Victim Wtiness Coordinator wages, benefits and expenses. Last month’s changes to the Juvenile Diversion Services to part-time and changed to just handle Diversion cases has been working. Attorney Jeani Stone and Wendy are working on the $50,000 State Biennium Grant. The archiving project has gone well and soon may open up some office space for an attorney. Met with State Budget Officer and Public Defender to discuss funding formula.

County Commissioners: Kelly: attended various County Board meetings and took quite a few calls. Bob: attended the Fair Board meeting, RT130 in Carlile, FAB meeting and AOP meeting, met with Larry & Jasmyne on the Fair fund raiser, took calls on roads and met with Morgan. Fred: attended various WCCA meetings via Teams, BHNFS meeting via teams, local cooperators FS meeting in Sundance, AOP in Newcastle, FAB meeting and Sage Grouse meeting, met with Morgan, Larry & Jeff and had conversations with the Cowboy State Daily on the Barlow Canyon Road.

Kelly moved to approve and for the chairman to sign 2 classification reviews for the County Clerk and County Road & Bridge. Bob seconded, all ayes, motion carried.

Donna Wolf was present to present a petition to Vacate a Portion of County Road No. 51, known as the Klondike County Road. Also present were Morgan Ellsbury, Sarah Pridgeon, Jeff Hodge, Joe Baron, DaNece Day, Everett Zimmershied, Dave Wolfskill and Diane Marshall.

After discussion Kelly moved to accept the petition. Bob seconded, all ayes, motion carried. Bob moved to appoint Morgan Ellsbury as viewer. Kelly seconded, all ayes, motion carried.

Morgan Ellsbury presented a preliminary speed study he performed on Barlow Canyon Co Rd No 6. Also present were Sarah Pridgeon, Jeff Hodge, DaNece Day, Donna Wolf, Everett Zimmerschied, Dave Wolfskill, Diane Marshall and via conference call, Stephanie Rathbun. After discussion it was determined that a formal speed study will be performed.

Bob moved to approve and for the chairman to sign an Agreement to Cover the Costs of County Road No. 51 known as the Klondie County Road. Kelly seconded, all ayes, motion carried.

Morgan Ellsbury, Road and Bridge Superintendent gave a monthly report.

Kelly moved to approve a Proclamation declaring April 7-13, 2024 as National Library Week. Bob seconded, all ayes, motion carried.

Ed Robinson, Homeland Security County Coordinator and Charlie Harrison, County Fire Warden, gave monthly reports.

Jayna Watson, AICP RLA, County Planning Consultant was present via conference call to discuss the RFP on updating the Crook County Comprehensive Land Use Plan. Also present were Ralph Goodson, Randy Leinen and Mary Yemington, CCLUP&Z board members, Sarah Pridgeon, Caleb Peters, Tim Lyons, Roger Connett and Joe Baron.

Tim Lyons, Planning Director, and Caleb Peters, Wastewater Specialist, County Planning, gave a monthly report.

Josh Jundt, Resident Engineer and Steve Dietrict, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.

Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor, continued their monthly reports.

Erik Akola was present to discuss maintenance of Old Sundance Co. Rd. No. 93. Also present were Rod Malo, Dave Ellsbury, Morgan Ellsbury, Sarah Pridgeon, Blake Homola, Larry Schommer, DaNece Day, Josh Undeberg and Scott Pomerenke. The following individuals addressed the board, Eric Akola, Rod Malo, Josh Undeberg and Scott Pomerenke. The Board maintained their position that they are not going to add the requested portion of Old Sundance Road to the maintained County Road list.

Board worked on their budget for FY 24/25.

Present for the discussion on whether to propose a Specific Purpose Option Tax be put on the ballot were Theresa Curren, City of Sundance Clerk, Tammy Jundt, Karla Brandenburg, Town of Pine Haven Mayor, Sarah Pridgeon, Bonnie Stahla, Morgan Ellsbury and DaNece Day.

After discussion it was determined to put the question on the general ballot and ask for $3,000,000 for each entity. All the towns will need to provide wording of their purposes for the tax and all information will be collected and put on a resolution for each entity to approve at their council meetings.

Present for the stacked Subdivision hearings were Sarah Pridgeon, Callie Hilty, Collins Massie, Steven & Holly Waliezer, Glenn & Janna Engelhaupt, Cathryn Glacken, Caleb Peters, Tim Lyons and DaNece Day.

After discussion Kelly moved to approve the Final Order Approving Minor Subdivision and the Minor Subdivision Plat for Massie Estates Minor Subdivision. Bob seconded, all ayes, motion carried.

Steven & Holly Waliezer requested a variance on the subdivision fencing requirements as their southern boundary is wall rock and they have fenced up to that point. Kelly moved to waive the fence requirements due to the circumstances. Bob seconded, all ayes, motion carried. Bob moved to approve the Minor Subdivision Recorded Subdivision Plat Agreement, the Order Approving Minor Subdivision and the Minor Subdivision Plat for Inyan Kara Creek Minor Subdivision. Kelly seconded, all ayes, motion carried.

After discussion Kelly moved to approve the Order Approving Subdivision Re-Plat and the Re-Plat for Reed Subdivision. Bob seconded, all ayes, motion carried.

After discussion Bob moved to approve the Order Approving Subdivision Re-Plat and the Re-Plat for Vista West No. 1 Subdivision. Kelly seconded, all ayes, motion carried.

After discussion Kelly moved to approve the Order Approving Subdivision Re-Plat and the Re-Plat for Pleasant Pines Subdivision. Bob seconded, all ayes, motion carried.

Soni Lampert, KLH, was present via Teams, for the monthly IT update. Also present were Julie Crawford, Tammy Jundt, April Gill, Jeff Hodge, Tim Lyons, Caleb Peters and DaNece Day.

Jeff Hodge, County Sheriff, was present to discuss dispatch call signs for the Commissioners, new fleet vehicles for the Sheriff’s Office and Dispatcher Wages.

Bob moved to allow the Sheriff to overspend a couple Dispatcher salary lines in order to keep current employees pay above new hires. Kelly seconded, all ayes, motion carried.

Rally Licenses: On May 8, 2024, at 11:00 o’clock a.m. in the Commissioner’s Room at the Courthouse in Sundance, Wyoming, the Board of Crook County Commissioners will be accepting requests for Twenty-Four Hour Special Malt Beverage Permits and Twenty-Four-Hour Special Catering Permits for biker rally week. Applications may be obtained from the Crook County Clerk’s Office or on the county website https://www.crookcounty.wy.gov/elected_officials/clerk/liquor_licenses.php. The application and fees must be returned to the Crook County Clerk by or before April 30, 2024, at 5:00 o’clock p.m.

Commissioner Scholarships: On May 8, 2024, at 11:15 a.m. the Board of County Commissioners will award 3 scholarships of $1,000.00, to a graduate of a Crook County High School and 1 renewal scholarship of $1,000.00, to a current college student who has received a prior Commissioner scholarship.
