PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS AT THE COURTHOUSE IN SUNDANCE, CROOK COUNTY, WYOMING

8:30 o’clock a.m. Present were Chairman Fred M. Devish, Vice-Chairman Kelly B. Dennis, Member Bob Latham and County Clerk Melissa Jones.

The Pledge of Allegiance was recited to the Flag.

Present to discuss opioid applications were Amanda Gaskin, MSW, PCSW, Clinician and Brea Terry, Case Manager, VOANR, Carol Stutzman, Nurse Manager and Katie Allen, Prevention Specialist, Public Health, and Joe Baron. After discussion, Bob moved to approve the application received from VOANR. Kelly seconded, all ayes, motion carried. The Board decided to hold on the application received from Crook County Public Health, as Katie asked to be able to gather more information about the project before funding approval.

Kelly moved to approve and ratify the minutes from January 2, 3 & 16 and February 1, 2024. Bob seconded, all ayes, motion carried.

Bob moved to approve a Service Agreement with Dru Consulting, LLC. Kelly seconded, all ayes, motion carried.

After discussion, Bob moved to approve an Agreement Concerning Abandoned Vehicles with Plains Towing and Recovery. Kelly seconded, all ayes, motion carried.

Kelly moved to approve the Kara Creek Country Living Minor Subdivision Plat. Bob seconded, all ayes, motion carried.

Kelly moved for the Chairman to sign a participation letter for the FY 2025 Emergency Fire Suppression Account. Bob seconded, all ayes, motion carried.

Tammy Jundt, County Treasurer, Joe Baron, County Attorney and via Teams, Julie Crawford, Clerk of District Court, were present to go over items of interest within their departments. Also present was Tracey Jundt.

Tammy Jundt, County Treasurer: Total receipts were $3,112,787.45 and disbursements to the county boards, towns and schools were $2,875,099.20. In January we did 3,515 transactions. We were very busy at the counter and received a lot of mail with many motor vehicle renewals. Worked on the 1099-INT’s for the 2023 CP redemptions and mailed them to the recipients. Attended the Treasurer’s virtual meeting via Teams discussing this year’s legislation session bills. We are watching some bills – all the ones on property tax, there is another bill with an alternative fuel tax amendment for electricity for electric vehicles, there is another on a sales tax revision, and also a bill on electronic registrations. Attended the IT training on phishing emails and attended the Employee Compensation Committee meeting and department head meeting.

Julie Crawford, Clerk of District Court: Total Receipts: $15,701.17 with $4,660.50 to the County 11 new case filings 32 record searches 6 new passports and assisted 5 customers with renewal passports 2 civil appeals in process We sent out 300 letters with juror questionnaires for the potential jurors to complete and return to our office for jury duty from April 1, 2024, through March 31, 2025.  So far, we have received 120 questionnaires back so we are starting to work through them to either qualify or excuse the jurors. I had my first meeting with the Supreme Court for e-filing and getting dates set up for training prior to going live on February 27th.  I traveled to Casper to the District Court office there to observe the e-filing process and see how their office is handling the paper submissions and the paperless e-filing submissions. I sent out letters to the Crook County and South Dakota attorneys advising them of e-filing and how to go about getting registered ahead of time.  I attended a Teams meeting for our FCE and CVJ program, a CSA Board Meeting here in Sundance, a special CSA Board Meeting via Zoom, the department heads meeting and a courtroom security meeting. 

Dan Thomas, County Assessor: This last month at the Assessor’s office we finished up a bunch of new construction reviews. We processed 33 deeds of transfer of ownership last month. I attended numerous legislative meetings via Zoom discussing bills that are being presented this upcoming session. I attended an online class. I attended the County Zoning Education Seminar. Valuation season is here so we have been busy getting everything to start setting values.

Joe Baron, County Attorney: Criminal Cases in the past month: New Cases:28 Closed Cases: 57 Current Case Load: 46 In Court: 59 times Juvenile/Diversion Cases: 43 Advise various law enforcement agencies, County Officers and Department Heads. Completed Audit Letter. Reviewed bonds. Worked with Planning Department on the enforcement of Subdivision Rules, exemption, and subdivision applications.  Prepared documents for the Reed Public Road Alteration. Met with Forest Service staff and Road and Bridge concerning the Forest Service Road Maintenance Agreement and discussed the FRTA Easements. Discuss FRTA easement issues with Senator Lummis office. Reviewed Improvement and Service District Hearing documents with County Clerk. Attend LUP&Z hearing, and Zoning Information Meeting. Revised Title 25 procedure. Worked on SBOE Appeals on behalf of Assessor. Reviewed Radio Agreements for Fire Radios. Reviewed Opioid Fund Grant requests. Attended IT training, department head meeting on IT contract. Testify before the Joint Appropriations Committee on behalf of all the state’s County Attorney’s for the $6,763,655 Budget 160 request from the state that partially funds County Attorneys for prosecuting state charges.  

Melissa Jones, County Clerk: Made 308 titles and recorded 423 documents. Updated tax rates in payroll system, updated Elected Official salaries in payroll system and vouchers, completed and sent out W-4s & 1099s, processed required January publications, completed the E911 report for the state, mailed out notice on Reed Road, sent out notice on Beulah I&S District, sent out letters to reserve polling places for this election cycle, processing various voter list request, those requests seem to be up this year, listened in on the SOS public comments on the Secretary’s proposed rules, attended the phishing training, Department Head meeting, Coalition meeting, and the 4 Growth Management meetings.

County Commissioners: Kelly: attended 3 of the 4 zoning meetings, various county board meetings, special Commissioner meetings, took dozens of phone calls on county zoning. Bob: attended fair board meetings, zoning meetings, special Commissioner meetings, phishing training, had conversations on county zoning and Old Sundance Road. Fred: attended special Commissioner meetings, various Zoom and Teams meetings regarding BLM & FS assessments, 3 of the 4 zoning meetings and phishing training, had conversations with Morgan & Larry on various items.

Tracey Jundt, Deputy County Assessor, presented the following tax corrections: C942818010025 & R0012878. Kelly moved to approve the corrections as presented. Bob seconded, all ayes, motion carried.

Bob moved to sign a letter of support to the Town of Hulett supporting their efforts to declare Hwy 24 in Crook County a Purple Heart Trail. Kelly seconded, all ayes, motion carried.

Alex Jessen, Chairman, Tammy Jundt and Bonnie Stahla, Members, Compensation Committee, gave a monthly report. Also present via Teams was Julie Crawford.

Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor gave monthly reports.

RESOLUTION 2024-4

AMENDING RESOLUTION NO. 12-2007

SETTING SIZE AND WEIGHT LIMITS ON COUNTY ROADS

IN CROOK COUNTY, WYOMING

WHEREAS the Board of County Commissioners by Resolution 12-2007 adopted uniform size and weight restrictions based upon the provisions of Title 31 Chapter 18 Commercial Vehicle Act to apply to all paved and unpaved county roads and bridges under their jurisdiction pursuant to Wyoming State Statute 31-18-802 (x); and

WHEREAS the Board of County Commissioners upon their authority from W.S. 24-1-104 to manage and control all county roads may from time to time review, revise and amend by resolution any mater concerning a county road without compliance with the Administrative Procedures Act in accordance with W.S. 16-3-101 (a) (ix) (E), and adopt any or all of the provisions of Title 31 Chapter 18 Commercial Vehicle Act to apply to county roads under their jurisdiction pursuant to Wyoming State Statute 31-18-802 (x); and

WHEREAS the County Sheriff and his deputies shall have enforcement authority pursuant to Title 31 Chapter 18 Commercial Vehicle Act on county roads pursuant to W.S. 31-18-805 for and provisions adopted by the County Commissioners; and

WHEREAS at certain times of the year due to weather and ground conditions much lower short-term size and weight limits may need to be imposed by the County to protect the paved and unpaved roads from being damaged; and

WHEREAS W.S. 31-18-802 (a) (viii) allows for the reduction in the maximum allowable axle loads and gross weight limits for specific county roads or sections thereof or for bridges by the county if the operation of vehicles or combination of vehicles would create undue damage to the county road; and

WHEREAS the placement of signs notifying users of county roads is the best way to notify users of the size and weight limits imposed by the county, and weight limit signs are already posted on many roads throughout the county by previous boards of county commissioners; and

WHEREAS there is a need for a uniform size and weight limit resolution pertaining to all the paved and unpaved county roads throughout the county unless otherwise set by the Board of County Commissioners and posted by the Crook County Road and Bridge Superintendent; and

WHEREAS it is in the best interest of the county taxpayers to protect the paved and unpaved county roads and bridges from being damaged by overweight vehicles; and

WHEREAS all existing size and weight limits shall remain in effect until modified by the Board of County Commissioners and posted by the Crook County Road and Bridge Superintendent; and

WHEREAS the Crook County Road and Bridge Superintendent is in charge of county roads and is in the best position to oversee the setting of size and weight settings on each county road; and

WHEREAS the Crook County Road and Bridge Superintendent may reduce the maximum allowable axle loads and gross weight limits for specific county roads or sections thereof or for bridges under his jurisdiction if the continued operation of vehicles or combinations of vehicles would create undue damage to the highways or bridges.

THEREFORE BE IT RESOLVED that the Board of County Commissioners in and for Crook County adopt by this resolution the following:

1. All of the provisions of Title 31, Chapter 18, Article 8 of the Wyoming State Statutes and any amendment thereto together with any Federal Regulation adopted by the State of Wyoming to apply to all of the bridges, and paved or unpaved county roads within Crook County, WY; and

2. Appoints the Crook County Road and Bridge Superintendent to act as the Director of county roads and empowering him with the same powers as the Director set forth in Title 31, Chapter 18, Article 8 of the Wyoming State Statutes and any amendments thereto; and

3. Adopts any existing size and weight limit on any bridge, and paved or unpaved county road previously adopted, set and posted by the Board of County Commissioners throughout the county as set forth in Title 31, Chapter 18, Article 8 of the Wyoming State Statutes and any amendment thereto or otherwise; and

4. Enacts and set a uniform size and weight limit for all paved and unpaved county roads throughout the county as set forth in Wyoming Statute 31-18-802 and any amendments thereto.

Motion made, seconded and carried in an open meeting on February 6, 2024.

Bob made a motion to waive the $200 fee for the Cindy Snell Wastewater Application. Kelly seconded, all ayes, motion carried.

Present for the final hearing of the Massie Estates Minor Subdivision were Collin Massie, Tim Lyons, Caleb Peters, Morgan Ellsbury and Joe Baron. After discussion, Kelly moved to approve the Order Conditionally Approving Minor Subdivision, Minor Subdivision Unrecorded Subdivision Plat Agreement and Minor Subdivision Plat for Massie Estates Minor Subdivision. Bob seconded, all ayes, motion carried.

Kadin Williamson and Callie Hilty were present to request a road width variance on a subdivision.

Kelly moved that upon application for a one (1) lot minor subdivision, the County would grant a variance from the 60-foot access easement requirement to the subdivision through state land. After discussion, Fred vacated the chair and seconded the motion. Kelly voted aye, Fred vacated the chair and voted aye, motion carried.

Tony Barton was present to give an update on the 2024 Winter Fest. Also present were Jasmyn Bryant, Larry Schommer, Alex Jessen, Joe Baron.

Present for the hearing to Alter a Portion of Public Road No. 282 known as the Reed Road were Mark Hughes, Tim Lyons, Morgan Ellsbury and Joe Baron.

After discussion, Kelly moved to approve the following Resolution:

RESOLUTION NO. 2024-5

ALTERING A PORTION OF A PUBLIC ROAD

KNOWN AS THE REED ROAD NO. 282

WHEREAS the Board of County Commissioners accepted a Petition filed by Cathyrn A. Glacken and others to alter a portion of a public road, known as the Reed Road, Road File No. 282 located across the following described real property, to wit:

T.50N., R.62W. OF THE 6TH PRINCIPAL MERIDIAN, CROOK COUNTY, WYOMING

SECTION 15: SW1/4NE1/4; NW1/4SE1/4; and the Reed Subdivision Plat recorded at Instrument No. 585590 located at File 452 Map 1414

WHEREAS an agreement was entered into for Cathyrn A. Glacken to pay for the costs to commence proceedings to determine whether or not to alter the public road;

WHEREAS Wyoming Statute 34-12-106 through 111 require that any public road be altered or vacated in a manner provided by law for the alteration or discontinuance of highways and such laws are set forth at Wyoming Statute 24-3-101, et sec., that allows for the establishment, alteration, and/or vacation of County roads;

WHEREAS a viewer was appointed pursuant to Wyoming Statute 24-3-105 and 106 who filed a written report with the Board recommending the public road known as the Reed Road be altered;

WHEREAS the Board resolved in Resolution No. 2023-21 to commence proceedings to alter said public road;

WHEREAS on January 4, 2024, the County Clerk mailed copies of the Petition to Alter a portion of Public Road, Resolution No. 2023-21 To Commence Proceedings to Alter a Portion of Public Road No. 282, known as the Reed Road, the Notice of Hearing, and the Viewer’s Oath and Report by U.S. First Class Mail, certified, return receipt requested to all parties having an interest in the land over which the road is proposed to be altered as required by W.S. 24-3-110;

WHEREAS James A Tagart, Jennifer J. Adams, Jeff Mickle, Ann Marie Mickle, Cathyrn A Glacken, Trustee of the Cathyrn A. Glacken Rev. Living Trust u/t/d May 15, 2020, Leonard B. Reynolds, Margaret E. Reynolds, Jeremy Dedic and Juan Flores, Co Personal Representatives of the Estate of William A. Teaney, the landowners affected by the alteration across their property have consented to the alteration;

WHEREAS the Notice of Hearing to alter said road was published in the Sundance Times, a newspaper of general circulation in Crook County, Wyoming for two (2) consecutive weeks on January 11 and 18, 2024 as required by and substantially in conformance with W.S. 24-3-110;

WHEREAS the Notice of Hearing to alter said road was published on the County Website from December 6th, 2023, as required by and substantially in conformance with W.S. 24-3-110; and

WHEREAS no objections were filed in writing with the County Clerk of Crook County at P. O. Box 37 Sundance, WY 82729 on or before noon on the February 6th, 2024, and no objections were made at the hearings held February 6th, 2024 at 3:30 p.m.;

THEREFORE BE IT RESOLVED AND ORDERED by the Board of County Commissioners in and for Crook County, Wyoming that:

1. The Public Road known as the Reed Road, Road File No. 282 on the Reed Subdivision Plat recorded at Instrument No. 585590 located at File 452 Map 1414 is ALTERED as shown on the Map of Survey recorded at Instrument No. 688138.

2. This Resolution shall be recorded in the land records with the Crook County Clerk, Sundance, WY and the term ALTERED, and the recording information of this resolution shall be electronically noted as a comment on the Reed Subdivision Plat and be noted upon the replat with reference to the recording data of the portions altered, vacated and established.

3. The County Clerk shall refund any unused funds deposited after all costs and expenses are paid concerning these proceedings.

8:30 o’clock a.m. Present were Chairman Fred M. Devish, Vice-Chairman Kelly B. Dennis, Member Bob Latham and County Clerk Melissa Jones.

The Pledge of Allegiance was recited to the Flag.

Josh Jundt, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.

Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor continued their monthly reports.

Josh Franzen, Crook County Fair Board Member, was present to discuss heating/cooling the indoor barn. The Board agreed to have the clerk create a line in the Facilities budget to receive donations to be used for updates to fair buildings.

Present for the monthly IT update from KLH were Tom Overstreet via Teams, Morgan Ellsbury, Joe Baron, Tammy Jundt, Tim Lyons and Julie Crawford.

Charlie Harrison, County Fire Warden, gave a monthly report.

Present for the joint meeting with CCLUP&ZC were Jayna Watson, AICP RLA, County Planning Consultant, Ralph Goodson, via conference call, Mary Yemington, Dustin Buckmiller, Morgan Ellsbury and Randy Leinen, CCLUP&ZC members, Tim Lyons, Caleb Peters, Joe Baron, Sarah Pridgeon, Karen Harvey, Frank Harvey, Randy Faust, Joy Cuillo, Ernie Reinhold, Barbara Anderson and Earl Voss.

Jayna presented the Board and Committee with a report from the public comment meetings. Public Comment meeting dates/places were advertised prior to the meetings for 2 weeks in the Sundance Times, Moorcroft Leader and Wyoming Pioneer, posted in 2 places on the county website, posted on the County Clerk’s Facebook page and was broadcast on Dirt Road Radio for 2 weeks. The following people addressed the Board with comments/questions: Joe Baron, Mary Yemington, Tim Lyons, Barbara Anderson, Ralph Goodson, Ernie Reinhold, Frank Harvey, Karen Harvey, Randy Leinen, Randy Faust and Joy Cuillo.

A RESOLUTION AUTHORIZING SUBMISSION OF A FEDERAL MINERAL ROYALTY CAPITAL CONSTRUCTION ACCOUNT GRANT APPLICATION TO THE STATE LOAN AND INVESTMENT BOARD ON BEHALF OF THE GOVERNING BODY FOR THE COUNTY OF CROOK

FOR THE PURPOSE OF:

The purpose of the grant request is to address the critical need for the replacement of outdated and unsafe mechanical systems within the courthouse. The existing HVAC and electrical systems pose significant safety risks and are no longer capable of providing a secure and functional environment. The grant will enable the comprehensive replacement of these antiquated mechanical systems, ensuring the safety, efficiency, and reliability of the courthouse’s infrastructure.

W I T N E S S E T H

WHEREAS, the Governing Body for the County of Crook desires to participate in the FEDERAL MINERAL ROYALTY CAPITAL CONSTRUCTION ACCOUNT GRANT program to assist in financing this project; and

WHEREAS, the Governing Body of the County of Crook recognizes the need for the project; and

WHEREAS, the Federal Mineral Royalty Capital Construction Account Grant program requires that certain criteria be met, as described in the State Loan and Investment Board’s Rules and Regulations governing the program, and to the best of our knowledge this application meets those criteria; and

WHEREAS, the Governing Body of the County of Crook

plans to match the requested Federal Mineral Royalty Capital Construction Account Grant from the following source(s): Crook County has already budgeted $500,000 to the Courthouse Revitalization for planning and development of this project. We will continue an assertive approach to project funding based on diversified revenue streams, resource development plans, and alternate loan/grant options to meet the financial needs.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE

County of Crook that a grant application in the amount of $2,741,515.00 be submitted to the State Loan and Investment Board for consideration at the 6/6/2024 to assist in funding the Courthouse Revitalization: Modernization of the Mechanical Infrastructure

BE IT FURTHER RESOLVED, that Larry Schommer, Facilities Maintenance Supervisor and Virginia “Sam” Burke, Secretary RBFF are hereby designated as the authorized representatives of the County of Crook to act on behalf of the Governing Body on all matters relating to this grant application.

Kelly moved to sign a letter to the Crook County Library, Crook County Public Health and VOANR regarding parking. Bob seconded, all ayes, motion carried.
