Bob moved to appoint Fred M. Devish as Chairman of the Board of Crook County Commissioners and to appoint Kelly B. Dennis as the Vice-Chairman of the Board of Crook County Commissioners. Fred seconded, all ayes, motion carried.
Bob moved to approve the following bonds: Fred M. Devish & Robert E. Latham, County Commissioner, Michael R. Frolander, County Coroner, Melissa Jones, County Clerk, Tamara L. Kelly moved to appoint Fred M. Devish as Crook County’s voting member of the Wyoming County Commissioner’s Association and member of the Crook County Volunteer Firefighters Association Advisory Board. Bob seconded, all ayes, motion carried.

RESOLUTION NO. 2023-1
DESIGNATING THE OFFICIAL DEPOSITORIES FOR CROOK COUNTY FOR 2023
WHEREAS Wyoming Statute §9-4-816 through 9-4-831 governs the deposits and investments of county funds by Crook County; and
WHEREAS Resolution No. 8-1996 Statement of Investment Policy for Crook County allows investment of county funds while assuring the maximum safety of those funds; and
WHEREAS Wyoming Statute §9-4-817 (b) requires the County Treasurer to select the institutions designated by the Board of County Commissioners in and for Crook County, Wyoming pursuant to the restrictions stated therein and pursuant to law; and
WHEREAS the following financial institutions and State Treasurer should be designated as the official depositories for the public funds invested by Crook County as authorized by Wyoming Statute §9-4-831, namely: Sundance State Bank, Pinnacle Bank, Summit National Bank and any investment made available to the county through the State Treasurer of Wyoming, including the local investment pool, known as Wyo-Star authorized by W.S. 9-1-416 and the long-term investments pool, known as Wyo-Star II Wyoming Class authorized by W.S. 9-4-831 (a) (xxvii);
THEREFORE, be it resolved by the Board of County Commissioners in and for Crook County, Wyoming that the above stated depositories are designated as the official depositories of Crook County, Wyoming and that the County Treasurer, County Fair and Library, other elected officers and departments are authorized to and shall only deposit and invest county funds in these depositories.

RESOLUTION NO. 2023-2
AUTHORIZING THE ACCEPTANCE OF NEGOTIABLE PAPER
IN PAYMENT OF FEES
WHEREAS Wyoming Statute §18-3-505 provides that the Board of County Commissioners may allow any county officer, agent or employee to accept negotiable paper including, but not limited to e-checks, credit and debit cards, electronic funds transfer in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit; and
WHEREAS any fees assessed for processing negotiable instruments, a credit card, other electronic funds payment or other payment shall be borne by the person tendering payment and any fees assessed for processing a credit card payment collected on behalf of the county and state shall be borne by the person tendering payment and not by the county and state; and
WHEREAS with respect to lender credit card and all other payment transactions the county is entitled to promptly present all negotiable paper to the bank upon which the negotiable paper is drawn for payment without any right of setoff or defense on the part of the issuer except as follows: Acceptance by the county of an expired card, Acceptance of a card for payment of an amount in excess of what the issuer authorized the county to accept, or Negotiable paper that is so improperly completed that the issuer cannot identify the card holder; and
WHEREAS any defense, claim or action that an individual using negotiable paper, a lender credit card and electronic funds transfers might have against issuers of the card shall not apply to the county, its officers, agents or employees or relieve the individual of responsibility for payment; and
WHEREAS the acceptance of negotiable paper or any other type of payment constitutes conditional payment for the amount owing. If the negotiable paper or any other type of payment is not dishonored the payment shall be effective on the date the paper was accepted by the county officer, agent or employee and receipted the same day, with the exception that the transaction could not be completed for a statutory reason. If the negotiable paper or any other type of payment is dishonored in the course of collection the conditional payment is of no effect and any receipt, certificate or license issued upon acceptance of the negotiable paper or any other type of payment is void. In the event any property including motor vehicle license plates is transferred or issued by the county or any of its officers, agents or employees upon acceptance of negotiable paper, and the paper is subsequently dishonored the county may rescind the transaction and a sheriff or other law enforcement officer may without prior court proceedings seize the property pursuant to W.S. 18-3-505(e). Neither the rescission nor seizure relieves the person presenting the negotiable paper from further civil or criminal liabilities as may be provided by law.
WHEREAS any negotiable paper including but not limited to e-checks, credit and debit cards, electronic funds transfer in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit, that is dishonored shall be collected in the following manner or a more restrictive if imposed by the officer or board:
1. Once the negotiable paper has been dishonored it shall be resubmitted once, and if still dishonored the officer, or employee within ten (10) days shall issue a written demand to make the payment.
2. Then if the payment remains unpaid the officer or employee shall rescind the transaction and deliver the dishonored negotiable paper to law enforcement for further action.
THEREFORE, be it resolved by the Board of County Commissioners in and for Crook County, Wyoming that:
1. Any county officer, agent or employee is allowed to accept negotiable paper including credit cards in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit.
2. Any county officer, agent or employee who accepts negotiable paper is not personally liable, if the paper is dishonored and follows the collection process as required herein. Any losses arising from dishonored paper shall be allocated to the respective funds for which the negotiable paper was accepted.
3. In the event of losses from dishonored paper when the county or any of its officers are collecting funds for the state or any other level or unit of government, such losses shall be allocated to and accepted by the governmental entity for whom the collections were made;
3. Any payment made thereby is conditional as set forth in Wyoming Statute §18-3-505; and
4. Any fees assessed for processing a credit card payment, negotiable paper or other electronic funds transfers shall be borne by the person tendering payment.

FISCAL YEAR 2022 BUDGET AMENDMENT
WHEREAS Crook County adopted the Fiscal Year 2022 Budget in accordance with the Wyoming Uniform Fiscal Procedures Act; and
WHEREAS the Board of Crook County Commissioners wishes to amend the adopted budget in accordance with the same Act; and WHEREAS, no protests were received regarding such transfer.
NOW, THEREFORE, BE IT RESOLVED that the following budget amendments are made.
• $14,061.60 to Cod Red Grant – From Unanticipated Revenues
• $18,367.00 to Sheriff Office Radios Grant – From Unanticipated Revenues

Jeff Hodge, County Sheriff, Tammy Jundt, County Treasurer, Dan Thomas, County Assessor, Julie Altaffer, Clerk of District Court and Joe Baron, County Attorney were present to go over items of interest within their departments.
Dan Thomas, County Assessor: Theresa and I were gone most of the month of December. I had a family emergency and personal leave, and Theresa was on a vacation. I have meetings with the Assessors Association January 9th-12th. I also have a class this month from January 24th-27th in Cheyenne. We had our two new Field Appraisers start in December they are learning quickly. I would ask that the Commissioners write a letter to remove Theresa from all accounts and add me to them. We will also need to replace her credit card for Thomas Bush and we will need to replace Nathan Dominguez Credit card for Blake Homola. There were 967 deeds filed last year with 44 of them being filed last month. Max is currently in the process of breaking up the large tracts onto our GIS and is mostly done but still working out some of them.
Tammy Jundt, County Treasurer: Total receipts were $4,550,939.06 and disbursements to the county, county boards, towns and schools were $2,862,894.54. In December we did 3,161 transactions. We have been very busy at the counter and received a lot of mail with the December 31st tax payments, and motor vehicle and mobile machinery renewals. My new hire started and is doing great. We generated and mailed the February motor vehicle renewal reminder cards. We have written approximately 28 checks for the 80 letters sent for the sales tax civil fee issue. I attended the Employee Compensation Committee and Department Head meeting. I also attended Tina’s retirement party and Theresa’s farewell party.
Julie Altaffer, Clerk of District Court: We went to new computer program, Full Court Enterprise (FCE), November 5th which replaced our old WyUser system. We are now using the same program as the Circuit Courts so there is more uniformity there. Chris Galloway started as my new Deputy on December 1st so that was good to have her in the office for a month prior to Tina’s retirement. She is doing well. In the spring/early summer, we are looking forward to E-Filing. There will be training in the upcoming months for that. House Bill 14 (HB0014) Civil Case Filing Fees-Amendments is up for discussion with the County Commissioners around the state later this month. Currently our civil filing fees are $120 and our probate filing fees are $160. We are requesting that the civil filing fees be raised to $160 so all filing fees are the same. With our new FCE system, probate cases are now under the civil filings, so we have two separate filing fees for the same civil category. By raising the civil filing fee to $160 to match the probate filing fee, this would take care of issues regarding confusion, consistency, and fairness. Also, raising of the civil filing fees would ensure a smoother transition to E-Filing when that goes into effect It is to be noted that this is NOT a tax, it is merely a user fee for our services. The filing fee is broken down into $40 for court automation fee, $10 for civil legal services fees and the rest goes to the county general fund. We are hopeful for the commissioner’s support when this bill comes up.
Jeff Hodge, County Sheriff: Presented jail statistics, office is down on radio and phone calls which is standard in winter, lost another deputy and dispatcher, hired another dispatcher, planning an emergency/active shooter training for courthouse employees, working with KLH on their contract, need to work on a way to dry wetsuits during emergency incidents, implementing a 5% increase on all patrol contracts, need to work on communications, communications are hard when many are still on analog radios.
Joe Baron, County Attorney: Criminal Cases: In the past month New Cases: 61 Closed Cases: 79 Current Case Load: 111 In Court: 39 times Juvenile Cases: We also have 26 cases involving minors in Juvenile Court or Diversion. 2022 Year End New Cases 176 Closed Cases 252 The Part-Time Deputy County Attorneys Jeani Stone and DaNece Day started handling some criminal cases on November 28. Prepared documents for vacating portions of County Road No. 160, and reviewed documents and questions on Road 807; reviewed Large Acreage Subdivision exemption request and prepared an Order for the Commissioners; reviewed bond forms for newly elected officials; reviewed tax payment issues; answered questions about the Opioid Settlements to the County; prepared documents for the Compensation Committee meeting to request the Commissioners authorizing two part-time Deputy County Attorney positions; assisted preparing for State Budget Item 160 hearing. Worked on Forest Service Planning documents.
Melissa Jones, County Clerk: office has been steady, recorded 491 documents, made 215 titles, down one employee, plan to work on interviewing and hiring in January, worked with Range on identifying line numbers and cleaning up our bill, worked with the Compensation Committee on a final draft of the handbook and revisions to the Salary Matrix, got election billing complete have received funds from a couple entities thus far, preparing for voter purge, worked on the County’s SAMs registration, working on end of year duties, prepping for new year duties (W-2’s, etc), tracking proposed legislation
County Commissioners: Bob: attended the Weed & Pest meeting Fred: attended WCCA meeting, scheduled to be in Douglas, virtually due to weather, spoke with Morgan about roads and snow issues Kelly: attended monthly board meetings.

Present for the continued large acreage subdivision exemption hearing for Black Hills Land were Garry Davis, Tim Lyons, Planning Administrator, Dan Thomas, County Assessor and Joe Baron, County Attorney. Hearing continued to Tuesday, February 7, 2023 at 2:00 PM.
Present for the large acreage subdivision exemption hearing for Wild West Hideaways were Garry Davis, Tim Lyons, Planning Administrator, Tracey Jundt, Deputy County Assessor and Joe Baron, County Attorney. Exemption was dismissed as not enough information was presented and applications were not completed.
A public hearing was held to commence proceedings for the identification of County Roads under W.S. 24-
3-201 through W.S. 24-3-206 to vacate the unused and unidentified portions of County Roads in Township
50 North, Range 66 West of the 6th P.M. pertaining to Pine Ridge County Road No. 205, Sundance-Wind Creek County Road No. 93 and Wagner County Road No. 160. No oral or written objections were received.

IDENTIFYING COUNTY ROADS AND VACATING THE UNUSED
AND UNIDENTIFIED PORTIONS OF COUNTY ROADS
IN A PORTION OF TOWNSHIP 50 NORTH, RANGE 66 WEST OF THE 6th P.M.
WHEREAS The Board of County Commissioners intends to identify county roads in accordance with Resolution No. 2019-4 located at Commissioners’ Proceedings Book 12 Page 5 within Township 50 North, Range 66 West of the 6th P.M. that are generally located east of Moorcroft, Wyoming and Southeast of Pine Haven, Wyoming in the Pine Ridge area under the identification procedure contained in W. S. 24-3-201 through 24-3-206:
WHEREAS the only county roads within the S1/2 of Section 11, S1/2 of Section 12, Sections 13, 14, 23, 24, 25, 26, 35, and 36 Township 50 North, Range 66 West of the 6th P.M., which shall exist after this identification procedure are generally shown on the MAP OF COUNTY ROADS attached to the Notice of Identification are:

All other county roads or portions of county roads within the S1/2 of Section 11, S1/2 of Section 12, Sections 13, 14, 23, 24, 25, 26, 35, and 36 Township 50 North, Range 66 West of the 6th P.M., the area identified in the MAP OF COUNTY ROADS which are not shown on the Map of County Roads shall be accordingly VACATED upon adoption of this resolution for identification; and
WHEREAS there is no evidence that the county has ever maintained the route of the Poston Road No. 160; and
WHEREAS the Notice of Identification of County Roads, together with a map identifying the county roads, was published for two (2) consecutive weeks in two (2) newspapers of general circulation within Crook County, the Sundance Times (the official County Newspaper), and the Moorcroft Leader on November 17, and 24, 2022, and published on the Crook County website at http://www.crookcounty.wy.gov from November 17, 2022; and
WHEREAS the Notice of Identification of County Roads, and the map of the county roads, were mailed on or before November 15, 2022 by U.S. Mail postage prepaid to all of the landowners located on the above described property and as set forth in the Certificate of Service dated November 15, 2022; and
WHEREAS no objections to or claims for damages by reason of this identification procedure were filed with the Crook County Clerk by noon on December 30, 2022 as required by the Notice of Identification of County Roads or received thereafter before or during this hearing; and
WHEREAS the portions of the County Road No. 93, 160, 205 and County Road Easement across Lot 64 and 65 of the Amended Pine Ridge Estates Subdivision to Crook County recorded at Instruments No. 423806 at Photo Book 205 at Page 389, and recorded at Instrument No. 424765 at Photo Book 207 at Page 411 are not vacated by this resolution; and
WHEREAS this process will have the effect of vacating the unused and unmaintained County Road No. 160 and any other county roads that crosses the following described properties:
Lots 17, 18, 19, 20, 32, 33, 43, 44, 45, 46, 74, 75 of the Amended Plat of the Pine Ridge Estates Subdivision plat recorded at Instrument No. 383428 at File 194 Map No. 154; and

THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS IN AND FOR CROOK COUNTY, WYOMING, that those portions of the county roads located in within the S1/2 of Section 11, S1/2 of Section 12, Sections 13, 14, 23, 24, 25, 26, 35, and 36 Township 50 North, Range 66 West of the 6th P.M., not set forth above and not shown on the MAP OF COUNTY ROADS are hereby VACATED pursuant to the identification procedure contained in W.S. 24-3-201 through 24-3-206, and the roads identified as referred to above and shown on the Map as county roads remain, are declared, altered and established as county roads.
IT IS FURTHER ORDERED that the County Clerk shall identify all of the county roads as set forth in this Resolution in the County Road Book and Highway Index and record this Resolution and the Map in the land records thereby pursuant to W.S. 24-3-118 (d).

Preston Beckstead, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.
Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Foreman, continued their monthly reports.
Melissa Jones, Secretary, Morgan Ellsbury, Tammy Jundt and Alex Jessen Members, Compensation Committee, gave a monthly report.
Bob moved to approve the Crook County Employee Compensation Committee Handbook as presented. Kelly seconded, all ayes, motion carried.
The County Attorney requested that the Deputy County Attorney position be allowed to be a full time or two part-time positions as determined by the County Attorney in accordance with the Crook County Employee Handbook. This will create a greater pool of applicants for this position from the limited number of attorneys seeking employment. The Compensation Committee reviewed the request and determined that since the Elected Official’s budgeted amount for the position will not change this fiscal year through June 2023. That the position be split at the discretion of the County Commissioners not the Compensation Committee.
Kelly moved to allow the Deputy County Attorney position to be split at the discretion of the County Attorney into two part-time positions in accordance with and as defined by the Crook County Employee Handbook. Bob seconded, all ayes, motion carried.
Tina Wood was present to request that to Board appoint her as an ex officio committee member. After discussion, Bob moved to appoint Tina as an ex officio committee member on the Employee Compensation Committee. Kelly seconded, all ayes, motion carried.

Kelly moved for the chairman to call a special meeting on the application process at the appropriate time and for signature stamps to be used on the Grant Resolution if necessary. Bob seconded, all ayes, motion carried.
