The Pledge of Allegiance was recited to the Flag.

The Commissioner meeting dates in August will be moved to Monday, August 1st and Tuesday, August 2nd due to the statutory requirement to pass the Mill Levy on the first Monday in August.

Jeanne moved to approve the following resolution:

RESOLUTION NO. 2022-17

RESOLUTION CONCERNING SPECIAL PROSECUTION

WHEREAS the Crook County and Prosecuting Attorney in 2019 entered into agreements with the Campbell County Attorney’s Office and the Weston County Attorney’s Office to review, prosecute and otherwise proceed to make, in their sole discretion, a proper disposition of all potential matters in which the Crook County Attorney’s Office has a conflict of interest;

WHEREAS various County and Prosecuting Attorney’s Offices and District Attorney Offices will provide their services free of charge to Crook County in exchange for the Crook County and Prosecuting Attorney’s Office acting in their county free of charge when conflicts of interest arise in their respective counties;

WHEREAS Crook County will reimburse other counties for all costs and expenses of review and prosecution; and

WHEREAS Wyoming Statute §18-3-302 authorizes said action and it benefits Crook County;

THEREFORE, be it resolved that the Crook County and Prosecuting Attorney is authorized to appoint any County Attorney or District Attorney and their respective deputies to act as special prosecutors in Crook County, Wyoming when appointed to do so by the Crook County and Prosecuting Attorney to act as such in any particular case.

Mike Frolander, County Coroner, gave a monthly report.

Jeff Hodge, County Sheriff, Tammy Jundt, County Treasurer and Tina Wood, Clerk of District Court, (via teams) were present to go over items of interest within their departments.

Jeff Hodge, County Sheriff: Discussed a dispatch position, got gear to protect jailers if they must go into a cell to break up a fight, presented the jail roster. Board presented Jeff with certificates of appreciation for Josh Throckmorton & Elsa Bush for their 5 years of service to Crook County.

Melissa Jones, County Clerk: Office made 353 titles, recorded 619 documents office has been busy working on next FY budget, payroll, accounts payable, Commissioner paperwork, working with county insurance company to make sure all property is covered that needs to be, working on documents with the Employee Compensation Committee, got through ballot proofs, held a test on the absentee machine had attendees, so appreciated that. Absentee voting started Friday, July 1, got all absentees requested thus far out in the mail on Friday and have the machine set up in the clerk’s office.

Tammy Jundt, County Treasurer: Total receipts were $2,626,989.25 and disbursements to the county, county boards, towns and schools were $2,244,920.90. In June we did 1,884 transactions. We were a little slower at the counter this month. So, we were able to catch up on other office work. The Wyoming County Treasurers had their annual meeting in Worland. I had planned on attending but I got sick and did not attend. I worked on the county budget with Melissa and entered May’s revenue on the budget worksheet. And attended the budget work sessions. I typed an estimated revenue spreadsheet for the Crook County Senior Services for their budget. I attended the Republican Party special meeting where they picked Melissa to be considered for County Clerk. Melissa got us set up to use the postal machine for our renewal reminder cards. Removed all old property tax roll computer tapes from our Sundance State Bank safe deposit box and closed the box. We did a couple redemptions on CPs from the tax sale. Invested the PILT funds of $836,606.00 in Wyoming Class. Currently, they have the highest interest rates. Met with Jerimiah Rieman regarding the mineral tax payments and he explained in more details how it works. In July we will start calling the property taxpayers who are on the delinquent list.

Joe Baron, County Attorney: Joe: New Cases: 40 Closed Cases:54 Current Case Load: 142 In Court: 55 times. Joe pretty much spent most of the time in court or preparing for court. Hired a Deputy County Attorney effective July 11, 2022. Continue to hold court in person and by less and less by Video Conference with TEAMS. Dealt with the County civil matters including but not limited to the following: Reviewed Bonds. Reviewed proposed Large Lot Rules with Land Use Planning and Zoning Commission. Reviewed proposed Subdivisions. Reviewed Contracts and MOUs, for Sheriff, Public Health, Clerk of District Court, Facilities. Reviewed Elections issues. Provided legal advice for elected officials and concerning duties.

Theresa Curren, County Assessor: Crook County Assessment approved for 2022 by the State Board of Equalization.  The commissioners can now work on the mill levy to be approved in August.  Field appraisers are inside Moorcroft City limits doing a review sweep for tax year 2023. 

Tina Wood, Clerk of District Court: I attended the Wyoming Clerks of District Court Association meeting in Wheatland the first part of June; worked on Child Support Authority Board business; I worked on the Salary Matrix RFP and attended the monthly meeting; both Julie and I have taken vacation; and the office has been busy with the day to day work.

County Commissioners: Kelly: Attended Republican central committee meeting, special meeting June 14th, budget hearings June 22nd & 23rd, budget hearings for Predator Board and Weed & Pest Board, and the political debate held for the Senate candidates in Moorcroft. Jeanne: Attended special meeting June 14th, attended budget hearings June 22nd & 23rd, met with extension agent to discuss MOU, worked with Dru and some citizens on our response to the BHNF Plan revision assessment.

Jeanne moved to approve the following resolution:

RESOLUTION NO. 2022-18

OPEN BURNING RESTRICTION AND

BAN ON THE USE OF FIREWORKS

WHEREAS, severe to extreme fire situation exists throughout Crook County, created by a heavy fuel load, dry conditions and extreme drought, have created situations that over-extend the firefighting capability of local government; and,

WHEREAS, Wyoming Statute 35-9-301 through 304 provides that upon the recommendation of the County Fire Warden the Board of Crook County Commissioners may close the area to any form of use by the public or limit such use which shall include the prohibition of any type of open fire for such periods of time as the Board may deem necessary and proper; and

WHEREAS, the County Fire Warden, Doug Leis has recommended that open burning restrictions be imposed throughout the county immediately; and

WHEREAS Wyoming Statutes 35-10-201 through 208 allow for the regulation of fireworks; and

WHEREAS, any violation of this resolution may be in violation of W.S. 35-9-304 punishable by up to 30 days in jail and up to a $100.00 fine or both together with restitution for the cost of fire suppression and damages to others caused by the violation of this resolution; and

WHEREAS, this open burning restriction and ban on the use of fireworks shall beginning immediately until rescinded by the Board unless temporarily lifted or imposed by the County Fire Warden.

NOW THEREFORE, BE IT RESOLVED THAT THE BOARD OF COUNTY COMMISSIONERS HEREBY RESOLVES as follows:

1. That the discharge of fireworks and all outdoor fires are prohibited in the unincorporated area of Crook County, Wyoming immediately on Friday, July 22, 2022 at 8:00 AM and ending no later than October 15, 2022 unless temporarily lifted or reimposed by the County Fire Warden during that term;

2. That the following terms shall govern outdoor fires in the unincorporated areas of Crook County, Wyoming:

(i) Trash or refuse fires, camp fires, and charcoal fires are prohibited;

(ii) Petroleum fueled stoves, lanterns, or heating devices are only permitted if such devices meet the fire underwriters’ specifications for safety;

(iii) Smoking is prohibited except within enclosed vehicles or buildings, developed recreation sites, or while stopped in an area at least three (3) feet in diameter that is barren or cleared of all flammable materials. Cigarettes, cigars, and pipe tobacco must be extinguished and disposed of properly and are prohibited from being thrown out from vehicles;

(iv) Use of acetylene cutting torches or electric arc welders are permitted, if used in a cleared areas ten (10) feet in radius, and a shovel and a pressurized fire extinguisher are present at site;

(v) Propane or open fire branding activities are permitted, if in cleared areas ten (10) feet in radius, and a shovel and pressurized fire extinguisher are present at the site;

(vi) Internal or external combustion engines including chainsaws, ATV’s and motorcycles shall have approved spark arrestors;

(vii) Use of a chainsaw is permitted, if it has a proper spark arrestor, and a shovel and pressurized fire extinguisher are present at the site; and

(viii) Discharge of fireworks are prohibited except as authorized by a permit granted by the Board of County Commissioners for public display.

3. All other open burning or outdoor fires are prohibited except as authorized by a permit granted by the County Fire Warden. Applications for a Burn Permit are available from the County Fire Warden. If the County Fire Warden denies the Application, the matter may be appealed to the Board of County Commissioners at their next regular monthly meeting by contacting the County Clerk. The County Fire Warden shall have the authority to determine the terms and conditions of the permit including requirements for proof of liability insurance with a minimum $5 million dollar general liability policy and a personal agreement to accept total financial responsibility for the cost of firefighting and any damages caused by the fire.

4. The ban does not include the listed exceptions set forth in Wyoming Statute 35-10-204, the areas within the incorporated cities and towns within Crook County, or federal lands managed by the Forest Service, Devils Tower National Monument, and BLM. These entities may impose more or less restrictive regulations. The Board of County Commissioners strongly recommend that the above listed agencies ban the sale and discharge of fireworks in their jurisdictions. If permitted, there is no guarantee that County fire units will be able to respond for assistance.

5. The County Fire Warden shall immediately provide a copy of this Resolution to the County Sheriff, State Land Commissioners, Bureau of Land Management, National Park Service, Keyhole State Park and State Forester and other state and federal agencies.

6. The County Fire Warden shall immediately post the fire ban signs throughout the county and notify the public through advertisement in each newspaper published in the County, by press release to the Radio and TV stations broadcasting within Crook County, by the Public Alert system, the WYDOT 511 system, County Web Site http://www.crookcounty.wy.gov Facebook and any other method that would economically notify the public.

7. If any portion of this resolution is ruled to be not effective by a court the remaining portion of this resolution shall remain in effect.

8. The County Fire Warden has the authority to temporarily lift and or reimpose this Burn Restriction and shall provide notice as set forth in paragraph 5 & 6 above until rescinded by the Board unless temporarily lifted or reimposed by the County Fire Warden during that term.

WHEREAS the Cold Springs County Road was petitioned for, surveyed, advertised and no claims for damages were filed so the road was declared a public highway on January 5, 1903 at Commissioners Proceedings Book 2 Page 202 and the Lost Canyon County Road was petitioned for, surveyed, advertised and no claims for damages were filed so the road was declared a public highway on January 6, 1909 at Commissioners Proceedings Book 2 Page553; and

WHEREAS the portions of the Cold Springs County Road No. 21 and portions of the Lost Canyon County Road No. 807 that are being petitioned to be vacated were altered and established by Resolution No. 2013-9, Resolution No. 2013-16 and Resolution 2013-2017 that vacated the old unimproved routes across the property to the current existing route on roads that cross the property; and

WHEREAS an agreement was entered into with Moskee Land Corp., LLC to pay for the expenses of the proceedings to determine whether or not to vacate the portions of these County Roads; and

WHEREAS W.S. 24-3-101, et seq., allows for the establishment, alteration, and/or vacation of County roads; and

WHEREAS a viewer was appointed pursuant to Wyoming Statute 24-3-105 and 106 who filed a written report with the County Clerk on May 31, 2022, recommending the nominated portions be vacated; and

WHEREAS the County Clerk mailed by first class mail to all of the petitioners, persons requesting notice, and landowners along the route of county roads No 21 and 807, and the viewer a copy of the Viewers Report and a written notice of a hearing to consider the report before the Board of County Commissioners on June 14, 2022 on or after 4:00 P.M .; and

WHEREAS the Board of County Commissioners voted to commence proceedings to vacate the portions of the roads petition to be vacated.

THEREFORE BE IT RESOLVED that proceedings be commenced to determine whether or not to vacate portions of Cold Springs County Road No. 21 and Lost Canyon County Road No. 807 pursuant to Wyoming Statute 24-3-101, et seq.

Casey Hendrickson, Manager-Hauling & Infrastructure, Minerals Technology American Colloid Company was present to discuss Little Missouri Road #200.

Fred moved to create a new budget line for lease of Road & Bridge superintendent’s vehicle and to finalize the contract at the August Commissioner meeting. Jeanne seconded, all ayes, motion carried.

Present for the budget discussion were Tammy Jundt, Larry Schommer, Morgan Ellsbury, Jeff Hodge & Tim Lyons.

Jeanne moved to set the final hearing on the Crook County Large Acreage Subdivision Regulation for Tuesday, September 6th, 2022 at 2:00 P.M. Kelly vacated the chair and seconded the motion. Jeanne voted aye, Kelly vacated the chair and voted aye, motion carried.

Present for the hearing on Hidden Canyon Estates minor subdivision were Caleb Massie (via Teams), Tim Lyons and Morgan Ellsbury.

Jeanne moved to approve the Minor Subdivision Unrecorded Subdivision Plat Agreement, the Order Conditionally Approving Minor Subdivision and the Minor Subdivision Plat with the conditions as set forth. Kelly vacated the chair and seconded the motion. Jeanne voted aye, Kelly vacated the chair and voted aye, motion carried.

Jeanne moved to conditionally accept the bond for Randy Linen, Treasurer, Crook County Library Board, as long as the notary stamp is added in the notary section and the bond is approved by the County Attorney and for the clerk to use the chairman’s stamp to approve once received. Kelly vacated the chair and seconded the motion. Jeanne voted aye, Kelly vacated the chair and voted aye, motion carried.

Jeanne moved to approve the Memorandum of Understanding Between Wyoming Department of Health, Public Health Division and Crook County for the Best Beginnings grant for $124,720.00 for the biennium. Kelly vacated the chair and seconded the motion. Jeanne voted aye, Kelly vacated the chair and voted aye, motion carried.

Notice: The Board of County Commissioners is requesting bids for county property insurance for a one-year term, starting August 15, 2022. All bids must be submitted to the Crook County Commissioners, P.O. Box 37, Sundance, WY, 82729, by or before July 28, 2022, at 2:00 o’clock p.m.

The meeting adjourned at 2:25 o’clock p.m. to meet in special budget session on July 15, 2022 at 9:00 o’clock a.m. in the Commissioner Room at the Courthouse in Sundance, Wyoming.
